Terms of Service

1. Acceptance of Terms

By accessing or using RaceBench (“the App,” “the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. RaceBench reserves the right to update these terms at any time, with notice provided through the App or via email. Continued use after changes constitutes acceptance.

2. Description of Service

RaceBench is a performance-tracking and social platform for radio-controlled (RC) racing. The Service allows users to record, analyse, and compare RC racing data, connect with other drivers, and participate in leaderboards and community features. RaceBench may ingest data from third-party platforms (including but not limited to timing systems, transponder services, and other racing data sources) to enrich the user experience.

3. Eligibility

You must be at least 13 years of age to use the Service. By creating an account, you confirm that you meet this age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. RaceBench does not knowingly collect personal data from children under 13. If we become aware that a user is under 13, we will promptly delete their account and associated data.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. RaceBench reserves the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Upload, post, or transmit content that is defamatory, obscene, abusive, or otherwise objectionable
  • Attempt to interfere with, compromise, or disrupt the Service or its infrastructure
  • Scrape, harvest, or collect data from the Service without prior written consent
  • Manipulate leaderboards, timing data, or race results through fraudulent means
  • Use automated systems (bots, scripts, crawlers) to access the Service without authorisation
  • Access or attempt to access another user's private setup data, profile data, or account information

6. User Content

You retain ownership of any content you submit, post, or display through the Service (“User Content”). By submitting User Content, you grant RaceBench a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, display, and distribute that content in connection with operating and promoting the Service. You represent that you have all necessary rights to grant this licence and that your User Content does not infringe on any third party's intellectual property or other rights.

7. Social Sharing and Visibility

RaceBench is a social platform. By default, the following information is visible to other registered RaceBench users:

  • Your public profile (name, avatar, club affiliations)
  • Your race results, meeting participation, and leaderboard positions
  • Your championship standings

RaceBench operates a three-tier visibility model:

  • Owner only: Data visible only to you (e.g., setup data by default, private notes)
  • Followers: Data visible to users who follow you (e.g., shared setups when you opt in)
  • Registered users: Data visible to all authenticated RaceBench users (e.g., race results, public profile)

You can change your visibility settings at any time from your profile settings. Unregistered visitors cannot see individual driver data. The public timing portal displays race results at the club level without linking to individual driver accounts unless the driver has opted in.

8. Setup Data

Vehicle setup data (suspension settings, gear ratios, tyre choices, electronics configuration, and similar competitive information) is treated as competitively sensitive. Setup data is private by default and visible only to you. You may choose to share specific setups with your followers by explicitly opting in on a per-setup basis. Shared setups are visible only to users who follow you and are never surfaced in public search results, leaderboards, or the timing portal.

RaceBench does not use your setup data for aggregate analysis, machine learning training, or any purpose other than displaying it to you and, where you have opted in, to your followers. You may revoke sharing on any setup at any time, which takes effect immediately.

9. Driver Opt-Out Rights

You have granular control over how your data is used and displayed on the platform. You may opt out of any of the following at any time via your profile settings:

  • Profile visibility: Hide your profile from other registered users. Your race results will still appear in club timing data but will not be linked to your account.
  • Setup sharing: Disable all setup sharing. This revokes follower access to all previously shared setups.
  • Rivalry opt-out: Remove yourself from automatically generated rivalry comparisons (see Section 10).
  • Leaderboard inclusion: Exclude yourself from cross-club and global leaderboards. Club-level results remain visible through the timing portal as they are club data.

Opt-out changes take effect immediately. Where technically feasible, historical data is updated to reflect your new preferences. Club-owned timing data (race results published by clubs) is governed by the club's data controller obligations (see Section 16).

10. Follow and Rivalry Model

RaceBench allows users to follow other drivers. Following is a one-way social action: when you follow a driver, you can see their public activity and any content they have shared with followers. Following does not grant access to private data such as setup configurations unless the followed driver has explicitly opted in.

Rivalries are automatically generated by the platform based on race co-occurrence (drivers who frequently compete in the same races and classes). Rivalry data is used to surface head-to-head comparisons, statistical trends, and competitive narratives. Rivalries are visible to both drivers involved and to their respective followers.

You may opt out of the rivalry system at any time via your profile settings. Opting out removes you from all rivalry pairings and prevents new rivalries from being generated for your account.

11. Community Club Configuration

RaceBench supports community-contributed club configurations. A club configuration includes the club's name, location, track layout, class definitions, and timing system settings. There is one configuration per club. Any registered user may create or contribute to a club configuration.

If you contribute to a club configuration, you are responsible for the accuracy of the information you provide. RaceBench does not verify club configuration data and accepts no liability for incorrect configurations.

A club owner (an individual who has claimed the club on RaceBench) may override community-contributed configuration at any time. Claiming a club transfers configuration authority to the club owner. Contributors are notified when their contributions are overridden.

12. Membership and Club Admin Obligations

Club administrators (owners and managers) have specific responsibilities when using RaceBench to manage club operations:

  • Club admins act as data controllers for club-level data (race results, meeting entries, timing data) under applicable data protection law.
  • Club admins must ensure that drivers are informed when their race data is published through RaceBench.
  • Club admins must respond to data access or deletion requests from drivers whose data they have published, in accordance with GDPR Article 15-17.
  • Club admins do not have access to individual driver portal data (setup data, private notes, follower lists, or account settings). Club admin access is limited to club-level operational data.
  • Club admins are responsible for the accuracy and appropriateness of data published through the club timing system.

13. Sponsor Challenge Opt-In

RaceBench may offer sponsor-backed challenges, competitions, or promotions (“Sponsor Challenges”). Participation in Sponsor Challenges requires explicit opt-in on a per-challenge basis.

When you opt in to a Sponsor Challenge, the following data may be shared with the named sponsor:

  • Your public profile information (name, avatar)
  • Your race results and performance data relevant to the challenge
  • Your leaderboard position within the challenge

The sponsor's identity and the specific data to be shared will be disclosed before you opt in. You may withdraw from a Sponsor Challenge at any time. Withdrawal immediately stops future data sharing with the sponsor. Data already shared prior to withdrawal is subject to the sponsor's own privacy policy, which will be linked at the time of opt-in.

14. Partner Portal

RaceBench may provide a Partner Portal to commercial partners (sponsors, manufacturers, distributors). The Partner Portal displays aggregated and anonymised data only, including:

  • Aggregate participation statistics (number of drivers, races, clubs)
  • Anonymised performance trends and product usage patterns
  • Regional and demographic breakdowns (without individual identification)

The Partner Portal does not provide access to individual driver data, personal profiles, or any information that could be used to identify a specific user. No individual driver data is shared with partners unless the driver has explicitly opted in to a Sponsor Challenge (see Section 13).

15. Third-Party Data Integration

RaceBench may integrate with or ingest data from third-party platforms, timing systems, and services. RaceBench does not control and is not responsible for the accuracy, availability, or reliability of third-party data. Your use of third-party integrations may be subject to those platforms' own terms of service and privacy policies. By connecting a third-party account, you authorise RaceBench to access and import relevant data in accordance with the permissions you grant.

16. Data Processing Agreement

Clubs that use RaceBench to publish race results, manage meetings, or operate timing systems act as data controllers for the personal data they process through the Service. RaceBench acts as a data processor on behalf of these clubs.

By claiming a club and using RaceBench's club management features, the club owner enters into a Data Processing Agreement (DPA) with RaceBench. The DPA governs:

  • The types of personal data processed (driver names, transponder IDs, race results, lap times)
  • The purposes for which data is processed (timing, results publication, leaderboards, championship standings)
  • Data retention periods and deletion obligations
  • Security measures applied to club data
  • Sub-processor disclosures (infrastructure providers used by RaceBench)
  • Obligations upon termination of the club's use of the Service

The full DPA is available upon request by contacting privacy@racebench.app. Clubs are responsible for ensuring they have a lawful basis for processing driver data and for informing drivers about how their data is used.

17. Subscription Plans and Payment

RaceBench currently offers a free tier. Paid subscription tiers may be introduced in the future. When paid features become available, pricing, billing cycles, cancellation policies, and refund terms will be communicated clearly before purchase. By subscribing to a paid plan, you agree to pay the applicable fees. RaceBench reserves the right to modify pricing with reasonable advance notice.

18. Intellectual Property

The Service, including its design, code, graphics, logos, and trademarks, is the property of RaceBench and is protected by intellectual property laws. Nothing in these Terms grants you any right to use the RaceBench name, logos, or branding without prior written consent.

19. Termination

RaceBench may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request a copy of your personal data before account deletion in accordance with your rights under GDPR Article 20 (data portability). Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive.

20. Disclaimer

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. RaceBench disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

RaceBench does not warrant that race data, timing information, leaderboard rankings, or any other data presented through the Service is accurate, complete, or current. Data imported from third-party platforms is provided without independent verification by RaceBench. Users should not rely solely on data from the Service for competitive, financial, or other consequential decisions.

21. Limitation of Liability

To the maximum extent permitted by applicable law, RaceBench and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

In no event shall RaceBench's total liability for all claims related to the Service exceed the amount you have paid to RaceBench in the twelve (12) months preceding the event giving rise to the claim, or £100, whichever is greater.

22. Indemnification

You agree to indemnify, defend, and hold harmless RaceBench and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of England and Wales. Nothing in these Terms affects your statutory rights under GDPR or the UK Data Protection Act 2018.
